1. Acceptance of Terms

These Terms of Service (the “Terms”) govern your use of the website and in-studio services provided by Softanova Ltd (“softanova,” “we,” “us,” or “our”). By accessing or using our website or booking any service, you agree to be legally bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the site or our services. You must be at least 16 to use the website and at least 18 to receive any tattoo or piercing service. If you are 16–17 and seek a consultation regarding future services, you may only do so under the supervision of a parent or legal guardian, and we will not perform services on minors.

2. Service Description

softanova operates a professional tattoo and piercing studio located at 147 Curtain Road, Shoreditch, London EC2A 3QE, United Kingdom. We provide custom tattoo design, tattoo application, piercing, aftercare guidance, and related consultations. We may add, modify, or discontinue features, pricing, or availability at any time without prior notice. All services are provided “as is” and “as available.” While we plan placement and technique carefully, human skin is variable; healing outcomes, pigment retention, and exact appearance over time will differ by person and cannot be guaranteed.

3. Health, Safety, and Niche-Specific Disclaimers

Tattoo and piercing procedures involve skin penetration and carry inherent risks, including but not limited to redness, swelling, irritation, infection, scarring, allergic reaction, keloids, and pigment migration. We operate with sterile technique, single-use needles, and hospital-grade disinfection protocols. Our aftercare guidance is provided for general informational purposes and does not constitute medical advice; always consult a qualified clinician for medical concerns. You are responsible for disclosing allergies, skin conditions, medications (including blood thinners, isotretinoin, antibiotics), and any relevant medical history during your consultation. We may decline or postpone a service if we consider it unsafe or unsuitable (for example, sunburned skin, active dermatitis, or intoxication). Government-issued photo ID is required for age verification. We do not provide services to persons under the influence of alcohol or drugs.

4. Booking, Deposits, Cancellations, and No-Shows

Appointments can be requested online or by phone. To secure an appointment, we may require a deposit that contributes to the final price. Deposits are generally non-refundable once a slot is reserved, as they cover artist preparation time and lost opportunity. If you need to reschedule, notify us at least 48 hours before your appointment; with timely notice, we will move your slot once without forfeiting the deposit. Late cancellations (under 48 hours) and no-shows forfeit the deposit and may require a new deposit for rebooking. Arrive on time; late arrivals may reduce session time or require rescheduling. Pricing depends on size, placement, complexity, and artist; we confirm the quote before starting the procedure.

5. Client Responsibilities

You confirm that you (a) are at least 18 for tattoo and piercing services; (b) have provided accurate personal and medical information; (c) will follow pre-procedure preparation (rest, hydration, nutrition, and avoiding alcohol 24 hours prior) and post-procedure aftercare instructions; and (d) accept responsibility for your design and placement decisions. We offer guidance and previews; however, final approval is yours. Once tattooing or piercing has begun, changes may be limited or impossible without additional sessions or costs. You must keep the procedure area clean and avoid activities that compromise healing (for example, swimming, tanning, or tight clothing over fresh work) until healed as advised.

6. Acceptable Use of the Website

You agree not to: (a) access, scrape, or crawl the site using automated means without written consent; (b) bypass or interfere with security controls, rate limits, or access restrictions; (c) upload malware, phishing content, or illegal material; (d) impersonate any person or misrepresent your affiliation; (e) submit false or misleading information through forms; (f) use the site in violation of applicable sanctions or export laws; or (g) engage in spam, harassment, or conduct that disrupts normal operation. We may suspend or block access that we consider abusive or unlawful. We reserve the right to cooperate with law enforcement where required by law.

7. Intellectual Property

All content on the site—including text, graphics, logos, icons, images, video, and code—is owned by Softanova Ltd or used under license and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial purposes. You may not copy, modify, distribute, publicly display, or create derivative works without our prior written permission. Unless expressly agreed in writing, softanova retains rights to tattoo designs, sketches, and stencils used in the creation of your piece (including the right to display healed photos with reasonable anonymisation). You must not reproduce artist designs for other studios or commercial products without written permission.

8. Photos and Portfolio Use

With your consent, we may photograph your tattoo or piercing for our portfolio, social channels, and marketing materials. We avoid identifying facial features unless agreed. If you withdraw consent later, we will stop using images going forward where feasible; previously printed or widely shared materials may not be retractable. You may request removal of identifiable images from our own channels where practically possible by emailing [email protected].

9. Pricing, Payments, and Tips

We provide clear pricing before your session. Unless otherwise stated, quotes include VAT where applicable. Payment is due at the end of each session. We accept common card methods and cash; we do not accept cheques. Tips are appreciated but never required. If additional sessions are needed due to design changes or improper aftercare, they are billed separately. Touch-ups for normal healing issues may be offered at our discretion within a reasonable timeframe; misuse or poor aftercare may invalidate complimentary touch-ups.

10. Third-Party Services and Links

The site may reference third-party resources (for example, map providers) for convenience. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and privacy notices. We do not endorse or make warranties regarding third-party services or information.

11. Privacy

We process personal data as described in our Privacy Policy, including booking details you provide and limited technical data necessary to operate the site. We use a consent-based approach for non-essential cookies. You can manage preferences via the footer link titled “Manage cookie preferences.” Do not submit special-category health data unless necessary for your safety; if you do, it will be handled confidentially and only for booking-related purposes.

12. Disclaimer of Warranties

The site and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that outcomes of any tattoo or piercing will meet specific aesthetic expectations, as skin type, lifestyle, and aftercare materially affect results.

13. Limitation of Liability

To the fullest extent permitted by law, Softanova Ltd and its artists, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of data, loss of goodwill, or downtime, arising from or related to your use of the site or services, even if advised of the possibility. Our total aggregate liability for direct damages shall not exceed the greater of (a) the amount you paid to us for the service giving rise to the claim in the 12 months prior to the event or (b) ÂŁ100. Nothing in these Terms limits liability that cannot be excluded under law (including death or personal injury caused by negligence, or fraud).

14. Indemnification

You agree to indemnify, defend, and hold harmless Softanova Ltd, its directors, employees, and artists from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the site or services; (c) content or information you submit to us; or (d) your violation of laws or third-party rights.

15. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to acts of God, fire, flood, earthquake, pandemic, war, terrorism, labour disputes, governmental action, power or internet failures, equipment or supplier outages, or third-party platform downtime. If a force majeure event affects your appointment, we will offer to reschedule at the earliest practical date.

16. International Use

We make no representation that the site or services are appropriate or available in all jurisdictions. Accessing the site from territories where its content is illegal is prohibited. Users are responsible for compliance with local laws where they access the site or receive services. Cross-border users should consider travel and healing constraints before booking multi-session projects.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of London shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the services, except that consumers resident in the EU or UK may bring claims in their home country courts where required by applicable consumer law. Nothing limits your mandatory consumer rights under applicable law.

18. Dispute Resolution

Before commencing formal proceedings, you agree to email us at [email protected] with a concise description of the dispute, your name, contact details, and supporting information. We will attempt to resolve the matter in good faith within 30 days. If unresolved, disputes may proceed in the courts identified above. Where permitted by law, you and we agree to bring claims only on an individual basis and not as a class or representative action.

19. Termination and Suspension

We may suspend or terminate access to the site or decline services at our reasonable discretion for breach of these Terms, unsafe conduct, abusive behaviour, or suspected fraud. Upon termination, provisions intended to survive (including intellectual property, disclaimers, limitations of liability, indemnification, and governing law) shall remain in effect. You may stop using the site at any time and may cancel future appointments pursuant to our cancellation terms above.

20. Changes to Terms

We may update these Terms from time to time. Material changes will be announced on the site at least 14 days before taking effect. The “Last Updated” date will be revised with each material revision. Continued use of the site or services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you should discontinue use and may cancel upcoming appointments consistent with our cancellation policy.

21. Entire Agreement; Severability; Assignment; No Waiver; Electronic Communications

These Terms together with the Privacy Policy constitute the entire agreement between you and Softanova Ltd regarding the site and services and supersede prior or contemporaneous agreements on the subject matter. If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect. You may not assign or transfer your rights or obligations without our prior written consent; we may assign these Terms in connection with a merger, acquisition, asset transfer, or by operation of law. Our failure to enforce a provision is not a waiver. You consent to receive communications electronically (including emails and on-site notices), which satisfy legal requirements for written communications under applicable eIDAS, UK Electronic Communications Act, or similar laws.
